IBERA Privacy and Cookie Policy

This Privacy- and Cookie Policy (hereafter “Privacy Policy”) is based on article 13 of the General Data Protection Regulation (hereafter “the GDPR”) and describes the rights and obligations of the International Board of Environmental Risk Assessors (hereafter “IBERA”) towards natural persons whose Personal Data are processed (hereafter “Data Subjects”), mainly in connection to the online sale and marketing of services.
This Privacy Policy regulates the processing of your Personal Data by the data controller vzw IBERA located at Avenue des Arts 53, 1000 Brussels, Belgium and registered in the BCE under the number 0772.706.651.
Please read this Privacy Policy carefully. It contains essential information over how we process your personal data and which cookies we use. By sharing your Personal Data on our Website www.ibera-certification.org, by contacting us by email/per phone or by submitting a question/complaint, you declare that you have read this Privacy Policy and that you expressly accept its content.
Article 1 Collected personal data
1.1 IBERA processes your Personal Data in the context of its activities. This concerns:
- Category 1: everytime you visit our Website, we can collect various personal data about you, in particular your IP-adres, surfing behaviour, region and search terms. You can find more information about the way we use cookies in Article 7;
- Category 2: if you call or mail us, we process your email-address and/or phone-number, as well as the data you disclose yourself;
- Category 3: when registering for our services we may process your surname and first name, possibly the name of your organisation or company and VAT number, address details, email, your education details (e.g., a transcript of your degree), your professional experience (e.g., a CV), letters from your supervisors / clients / (previous) employers, your current profession/position, sector of employment, financial information (e.g., credit card information), possibly a picture of you, your payment information (e.g., credit card name, type, number, expiration date, bank account number), your membership type (based on the World Bank income classification) and your membership category (e.g., charter member, diplomate, emeritus diplomate, adjunct).
- Category 4: for surveying the satisfaction of our members and applicants, to notify you about upcoming activities, exam deadlines, new services, volunteer obligations and opportunities on IBERA council, ad-hoc groups, and committees or other information we think you might find interesting we process your name and email address.
1.2. IBERA may collect your personal data in different ways:
- through your contact or registration by email and/or through our registration portal; and
- our Website uses cookies and similar techniques to collect some Personal Data. For the stipulations on the use of cookies, see Article 7.
Article 2 Purposes of the processing
2.1. General purposes:
We will use your Personal Data exclusively for:
- Category 1: the maintenance and improvement of our Website and the inclusion of Personal Data in anonymous statistics, from which the identity of specific persons or companies cannot be traced, and for marketing purposes with as legal basis your explicit, prior consent given on your first visit to our Website;
- Category 2: being able to answer the question you have asked on the legal basis of providing you with a service you asked for and for which the processing of your Personal Data is necessary;
- Category 3: the delivery and invoicing of services ordered by you, with as legal basis the performance of a contract that you have requested and for which the processing of your Personal Data is necessary because it is required by law or because IBERA has a legitimate interest in doing so or because IBERA is obligated by law to process the information (e.g., invoicing information).
- Category 4: surveys, actions and promotions by IBERA, with as legal basis our legitimate interest with regard to existing members or your explicit, prior consent if you are not yet a member of IBERA. You can indicate at any time that you no longer wish to receive our marketing communication via the opt-out option in our emails or by contacting us directly by email or telephone.
2.2. Direct marketing:
We also use your Personal Data for direct marketing purposes, but only if you give us your explicit consent (“opt-in”) or if you are one of our existing customers.
You can revoke your consent to direct marketing at any time, at no cost and without stating any reason. All our marketing emails contain an unsubscribe link at the bottom of this email.
Article 3 Transfer to third parties
We never pass on your data to third parties for commercial reasons. If necessary due to internal reorganisation or transfer of activities, we may transfer your data to new entities within the IBERA group or to third parties who may guarantee the continuity of our services. IBERA will always inform you in advance to the extent possible, but you understand that this is not technically or commercially feasible in all circumstances.
In rare cases, we may be obliged to disclose personal data on the basis of a court order or to comply with other mandatory laws or regulations. We will do our best to inform you in advance, unless this is not possible for legal reasons.
We do share your data with third parties in the context of providing our service. Your data may be transferred to and processed by software and cloud providers, financial partners, a partner who oversees the examination (e.g., Prometric), a partner who provides the registration service (e.g., SETAC) or any other third party involved in the service. The current list can be obtained upon simple request by email. For each transfer to a third party, we ensure the appropriate security measures with respect to your personal data, including the conclusion of processing agreements where necessary.
We always try to make maximum use of European suppliers, but if we have to rely on non-European third parties we ensure that your data is just as safe outside Europe as it is here in Europe. Thus, where necessary, we will execute Standard Contract Clauses with these partners and provide additional guarantees.
Article 4 Duration of the processing
We retain your Personal Data as long as necessary in function of the purposes of the processing.
If you do not interact with the IBERA platform (e.g., renew your certification, register for an examination, update your contact information, …) for 5 years, we will delete your customer profile.
For the retention period of the data collected by cookies, see Article 7.
For legal reasons we must keep your invoicing data for 7 years from the calendar year following the last invoice date.
Article 5 Your rights
You have the right to access your Personal Data and the ways in which we use it at any time, free of charge. You have the right to request us to correct, supplement or remove your Personal Data. In a number of cases listed in the GDPR, you may also ask us to limit the processing of your Personal Data. You have the right to object to the processing of your Personal Data if you have serious and legitimate reasons that exceed our need to process your Personal Data. You also have the right to object at any time to the use of Personal Data for direct marketing purposes, even without having to give a reason. You have the right to request your Personal Data in digital and readable form and/or to have them transferred to another service provider of your choice. Insofar as our processing is based on your prior consent, you have the right to revoke that consent at any time.

Article 6 Security and confidentiality
We have taken the appropriate technical and organisational security measures to ensure the safety of your Personal Data. Under no circumstances can IBERA be held liable for any direct or indirect damage resulting from the erroneous or unlawful use of the Personal Data by a third party.
